Terms of Service
1. Acceptance of these terms
These Terms of Service form an agreement between you and Hospital Pricing Specialists, the operator of hospitalstatistics.com. By using Hospital Statistics, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the service.
2. The service
Hospital Statistics lets you compare hospitals with their peers using Medicare cost report data, hospital price data, and related public information. We may add, change, or remove features at any time. Some features may be offered as part of a paid plan.
3. Accounts and sign-in security
You may need an account to use parts of the service. You can sign in with Google, Apple, your email address, or your phone number. You must give us accurate information and you must be at least 18 years old. You are responsible for keeping your sign-in methods secure and for activity on your account. Tell us right away at rick@hospitalpricingspecialists.com if you think someone has used your account without your permission.
4. Acceptable use
You agree to use the service lawfully and fairly. You may not:
- scrape, crawl, or harvest data from the service by automated means, or copy the service's data in bulk;
- resell, redistribute, or republish the service's data or reports as a product or service of your own;
- attempt to break, overload, probe, or gain unauthorized access to the service or its systems;
- share your account with others or use the service in a way that violates any law or the rights of others.
5. Subscriptions and billing
Paid plans are billed through Stripe. The price, billing period, and other details are shown at the time you purchase. Subscriptions renew automatically until you cancel. You can cancel at any time, and your plan will stay active until the end of the period you have already paid for, unless the details shown at purchase say otherwise.
6. Data sources and accuracy
The information in Hospital Statistics comes from public sources, including Medicare cost reports and CMS data, and from hospital published price data. We provide it as is. We work to present it carefully, but public data can contain errors, delays, and gaps, and we cannot promise that it is complete, current, or accurate. The service is for general information only. It is not financial, legal, or clinical advice, and you should not rely on it as a substitute for advice from a qualified professional.
7. Intellectual property
The Hospital Statistics name, website, software, design, and the way we organize and present data belong to Hospital Pricing Specialists or its licensors and are protected by law. We give you a limited, personal, non-exclusive right to use the service under these terms. Underlying public data remains subject to the terms of its original publishers.
8. Termination
You may stop using the service and ask us to delete your account at any time. We may suspend or end your access if you break these terms, if we need to protect the service or other users, or if we stop offering the service. Sections that by their nature should continue to apply after termination will do so.
9. Disclaimer of warranties
The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not promise that the service will be uninterrupted or free of errors.
10. Limitation of liability
To the fullest extent allowed by law, Hospital Pricing Specialists will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the service. Our total liability for any claim related to the service will not exceed the amount you paid us in the twelve months before the claim arose, or one hundred dollars if you have not paid us anything.
11. Governing law
These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in California, and you agree to their jurisdiction.
12. Changes to these terms
We may update these terms from time to time. When we do, we will change the effective date above. If a change is significant, we will tell you by email or on the site. If you keep using the service after a change, you accept the new terms.
